  • Sources of Constitution

1.  International Decisions (Laws):  Some international decisions made by international bodies, such as UNO and AU, indirectly influence the constitution of a country.

2. Decrees/Edicts: A decree is a law or official order made by the government or person with power. In Nigeria The Military rule with decrees and edicts.

Military decrees have been used in passing laws and creating states or government agencies. The Land Use Decree of 1978 and the Indigenization Decree of 1977 are good examples. Laws passed by regional/state governments during military regimes are known as edicts.

3. Acts of Parliament: The law passed by the National Assembly or legislature in past years could be used in forming a new constitution in Nigeria.

4.  Judicial Precedents / Case Laws: The writings of renowned and respected legal luminaries have been used in the formation of Nigerian constitutions. Also, some courts make decisions on new areas which then form part of the constitution.

5. Historical Documents: Each nation of the world has a history. The history of a country can be a source of the constitution, the gathered history of past political events and activities alike.

6. Customs and Traditions: The customs and traditions of the people are also included in the constitution. For example, It is traditional that the first son shall inherit his father’s house and property.
