Rights and Obligations of Employer and Employee

This is a contractual agreement between an employer and his employee, where the employer hires the employee to work for him for an agreed remuneration.

Who is an Employer?

He is the one who undertakes to provide work for others usually for payment.

Who is an Employee?

The employee is one who undertakes to perform services under the direction and control of another person known as the employer usually for payment.

Right and Duties or Obligations of the Employer

1. The employer has the obligation to furnish his employer with a reasonably safe place in which to work.

2. The employer has the obligation to accept responsibility for any personal injuries sustained by his workers in the course of performing their duties.

3. He must pay his employers for the service.

4. The employer has the right to use the invention of his employee if the invention was discovered during working hours and with the materials and equipments.

5. When the employee’s misconduct has imposed liability upon the employee will be required to indemnify the employer for the loss which the employee has caused. 

6. The duty of the employer is to provide working tools that are necessary for work by the employee.

Right and Duties or Obligations of Employee

1. It is the duty of the employer to serve his employee honestly and faithfully.

2. The employee must obey reasonable regulations and requirements adopted by the employer.

3. The employee is under obligations to render or perform the services as required by the contract of employment.

4. The employee will exercise due care and diligence in view of the nature of the work.

5. He is not to disclose his employers trade secrets.

6. He should be regular and punctual at work.

7. He is entitled to receiving his wages from the employer.
